At ZIMARK LTD. (“ZIMARK” and/or “We”), we recognize that privacy is important. This Privacy Policy applies to all of the software, services, content, information, tools, features and functionality located on ZIMARK Application (“App”) and Website and governs the processing and transfer of Personal Data (as defined herein below), directly or indirectly, when you sign up to the Application which is designed to facilitate the services offered under a separate agreement between your employer and ZIMARK (“Customer”) or merely when you visit our website (“Prospect”) (collectively the “Services”), and covers how personal information that ZIMARK collects and receives is treated.
This Privacy Policy further explains how we safeguard your Personal Data and how you may exercise your rights related to your Personal Data, among others, and where applicable, as required according to applicable laws.

1. General principles.
ZIMARK is committed to ensuring that your personal data and data privacy are protected in accordance with the best practices available, as well as according to ZIMARK’s relevant legal obligations. This Policy explains your rights regarding the personal data ZIMARK collects and processes, including via the Application and Website. Your personal data will be collected and stored lawfully, fairly and transparently by ZIMARK. In processing your data, We act in good faith, in a proportionate manner, and with the appropriate technical and organizational measures. You are not required by law to provide us with any Personal Data. Sharing Personal Data with us is entirely voluntary.
2. Information We Collect and How We Use It.
In order to provide our Services, we may collect two types of information from you.
The first type of information is non-identifiable and anonymous information (“Non-Personal Data”). We are not aware of the identity of the individual from who we have collected the Non-Personal Data. Non-Personal Data which is being gathered consists of technical information, and may contain, among other things, the type of operating system and type of browser, type of device, your actions in the Application or Services (such as session duration).
The second type of information is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual (“Personal Data”).
For the avoidance of doubt, any Non-Personal Data connected or linked to Personal Data shall be deemed as Personal Data as long as such connection or linkage exists.
The information below details the types of Personal Data we process, the purpose, and the legal basis for each processing activity:
a) Information You Provide as prospect – In the event you contact us with any inquiries, by sending us an email or by any other means of communications through the Website, you will be requested to provide us with your full name and email address. In addition, you can choose to provide us with additional information as part of your correspondence with us. We will process your contact information solely for the purpose of responding to your inquiries and provide you with the information you have requested. The correspondence and its contents with you may be processed and stored by us in order to improve our customer services and in the event we believe it is required to continue to store it, for example, in the event of any claims or in order to provide you with any further assistance (if applicable).
b) Information You Provide as Customer – When you sign up and/or use the Services, we may ask you for registration information including without limitation: user name, password, phone number and email address. We process your Personal Data only for provision of the Services. We ask only for data that is adequate, relevant and not excessive for those purposes. We may use your email address, without further consent, for administrative communications such as notifying you of major Application updates, for customer service purposes, to address copyright infringement or defamation issues, or to contact you regarding any content that you have posted to or downloaded from the Application.
c) Aggregate Information – When you use our Services as a Prospect or as a Customer, we automatically receive and record aggregate information including, without limitation, in respect of: (i) account activities, your users’ activities with regards to any type of scanning that was done using the App; (ii) documents and browser, including your cookie information, software and hardware attributes which include online identifiers, such as Internet Protocol (IP) address and Cookie ID, unique identifiers (“Online Identifiers”).; (iii) location.
ZIMARK uses all of the information that we collect to understand the usage trends and preferences of our users, to improve the way the Application and Website works and looks, to inform Customers about statistic information regarding users’ exposure to the Services and to create new features and functionality. Online Identifiers and cookies are used, in particular to operate the Website and enable its proper functionality, for example to automatically recognize you by the next time you enter the Website.
d) Document Download – We may download/store cache content you created or uploaded to our Application on our servers for the sole purpose of obtaining the functionality of the Service.
e) User Communications – When you send email or other communication to ZIMARK, we may retain those communications in order to process your inquiries, respond to your requests and improve our Services.
In addition, we may use certain Personal Data to prevent potentially prohibited or illegal activities, fraud, misappropriation, infringements, identity thefts, and any other misuse of the Services and to enforce the Terms and Conditions as defined below, as well as to protect the security or integrity of our databases and the Services, and to take precautions against legal liability. Such processing is based on our legitimate interests.
Maintenance – ZIMARK uses the information that you provide or that we collect to operate, maintain, enhance, and provide all of the features and services found on the Application.
3. How We Collect Information.
Depending on the nature of your interaction with the Website, Application and Services, we may collect information as follows:
Automatically – we may use cookies (as elaborated below) or similar tracking technologies to gather some information automatically when you interact with our Website.
Provided by you voluntarily – we will collect information if and when you choose to provide us with the information, such as through the Services, contact us communications, registration, etc.
Provided by Third Parties – our third parties service providers which collect personal data on our behalf, such as content enrichment service providers.
4. Cookies.
When you use our Website, we may send one or more cookies – a small file containing a string of characters – to your computer that uniquely identifies your browser. We use cookies to improve the quality of our service by storing user preferences and tracking user information. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some Services may not function properly if your cookies are disabled. ZIMARK may use “Automatically Collected” information and “Cookies” information to: (a) automatically update the Service on your system; (b) remember your information so that you will not have to re-enter it during your visit or the next time you access; (c) monitor aggregate site usage metrics such as total number of visitors and pages accessed; (d) provide such metrics to users as they pertain to such user’s uploaded content; and (e) track your entries, submissions, and status in any promotions or other activities. You can change your settings and preferences on the Website.
Use of Remarketing with Google Analytics:
ZIMARK collects cookies on our Web site to capture information about page visits. This information is anonymous and ZIMARK uses this information only internally – to deliver the most effective content to our Website visitors. Information from the cookies is used to gauge page popularity, analyze traffic patterns on our site and guide development of other improvements to our site. ZIMARK does not require that you accept cookies, however, some functionality on our Web site, our product or service check-out process, and products and services may be disabled if you decline to accept cookies. You can set your browser to notify you when you receive a cookie, giving you the chance to decide whether or not to accept it. If you choose to e-mail us and provide personally identifiable information about yourself, ZIMARK will use this information only to respond to your inquiry. ZIMARK will not sell, rent or otherwise disclose that information to third parties unless such disclosure is necessary for the purposes set forth in this Policy, by law or a policy or notice contained or associated with a specific ZIMARK product or service.

5. Data Retention.
We retain Personal Data we collect as long as it remains necessary for the purposes set forth above, all in accordance with applicable laws, or until an individual expresses a preference to opt-out.
Other circumstances in which we will retain your Personal Data for longer periods of time include: (i) where we are required to do so in accordance with legal, regulatory, tax, or accounting requirements; (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges; or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Data. Please note that except as required by applicable law, we may at our sole discretion, delete or amend information from our systems, without notice to you, once we deem it is no longer necessary for such purposes.
6. Transfer of data.
ZIMARK may need to transfer the data submitted by you for the purposes described above to parties in locations outside the country in which you are physically located, potentially including countries which may not require an adequate level of protection for your personal data compared with that provided in your country. We will take appropriate measures to ensure that your Personal Data receives an adequate level of data protection upon its transfer. You may exercise your rights, where applicable, to receive information regarding the transfer mechanism that was used during such transfer. By accepting this Policy, you consent to the data transfer as described in this section.
7. Purpose and Choice.
If we use your personal information in a manner different than the purpose of the Services, then we will ask for your consent prior to such use.
8. Sharing Data with Third Parties.
ZIMARK only shares personal information with other third parties in each of the following limited circumstances:
a) We have obtained your consent.
b) We provide such information to our parent companies, subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf solely for the purpose of providing the Services. We require that these parties agree to process such information based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures. These third parties have access to Personal Data needed to perform their functions, but they are prohibited from using your Personal Data for any purposes other than providing us with requested services.
c) We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable agreements and/or their terms, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against imminent harm to the rights, property or safety of ZIMARK, its users or the public as required or permitted by law.
9. Sensitive Information & Information about third parties.
You may not post, transmit or publish through the Services any information about third parties without having their explicit consent. You may not upload post, transmit or publish through the Services any sensitive information, whether the information is yours or another’s.
10. Information Security.
We take security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. We strive to maintain the reliability, accuracy, completeness and currency of Personal Data that we collect and to protect the privacy and security of our users. We keep your Personal Data only for as long as reasonably necessary for the purposes for which it was collected or to comply with any applicable legal reporting or document retention requirements.
We have reasonable physical, electronic, and procedural security measures and safeguards to protect personal information. Our servers and our databases are protected by industry standard security technology, such as industry standard firewalls and password protection.
In addition, you agree to provide true, accurate, complete and current information. For your protection you agree not to share your registration information (including your username and email) with any third party for any purpose and you are aware that the said information is under your sole responsibility. You are solely responsible for protecting the information on your computer / mobile device and such as by installing anti-virus software, updating your applications, password protecting your files, and not permitting third party access to your computer / mobile device.
Please contact us at: info@zimark.io, if you feel that your privacy was not dealt with properly, in a way that was in breach of our Privacy Policy, or if you become aware of a third party’s attempt to gain unauthorized access to any of your Personal Data. We will make a reasonable effort to notify you and the appropriate authorities (if required by applicable law) in the event that we discover a security incident related to your Personal Data.
11. Children.
If you are a child under the age of 18 or such older age that is required by the jurisdiction of your residence, you must obtain parental consent prior to using our Service. ZIMARK will not knowingly contact or engage with children under the age of 18 without said parental consent. If you have reason to believe that a child has provided us with their personal information, please contact us at the address given above and we will delete that information from our databases.
12. Your Rights Related to Your Personal Data.
Upon receipt of your written request and enough information to permit us to identify your personal information, we will disclose to you the information we hold about you. We will also correct, amend or delete any personal information that is inaccurate and notify any third party recipients of the necessary changes.
Requests to delete personal information are subject to any applicable legal obligations imposed on ZIMARK.
We ask individual users to identify themselves and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical, or for which access is not otherwise required, and all in accordance with applicable laws.

ZIMARK regularly reviews its compliance with this Policy. Please feel free to direct any questions or concerns regarding this Policy or our treatment of personal information by contacting us as provided above.
When we receive formal written complaints it is ZIMARK’s policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal information that cannot be resolved between ZIMARK and an individual.
14. Changes to this Privacy Policy.
We reserve the right to amend this Privacy Policy from time to time, at our sole discretion. The most recent version of this Privacy Policy will always be posted on the Website and Application and the update date will be reflected in the “Last Amended” heading. We will provide notice to you if these changes are material, and, where required by applicable law, we will obtain your consent. Any amendments to the Privacy Policy will become effective immediately, unless we notify otherwise. We recommend you review this Privacy Policy periodically to ensure that you understand our most updated privacy practices.
