Important: by accessing and/or using Zimark Ltd.’s (“Company”, “us” or “we”) website or any of its mobile applications (each and collectively, the “Services”), you acknowledge and agree that we may process your Personal Data (as defined below) in accordance with this Privacy Policy. If you do not accept this Privacy Policy, please do not access the Company’s Services.

Personal Data” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. The Personal Data collected or processed by the Company is detailed herein.

This Privacy Policy describes Company’s data practices regarding Personal Data we collect in compliance with applicable data protection laws.

This Privacy Policy does not apply to any Personal Data collected by third party websites or apps not operated by the Company.

You are not legally required to provide us with Personal Data, however, some parts of our services may require you to do so. In these cases, if you choose to withhold any Personal Data we request, it may not be possible for you to access or use certain features of the Services. We recognize that privacy is important. This Privacy Policy applies to all of the services, information, tools, features and functionality offered by the Company or its subsidiaries or affiliated companies and covers how we treat Personal Data.

1.Information We Collect and How We Use It

In order to provide and operate the Services and provide other services in connection therewith, we collect and process Personal Data, including the following types of information:

1.1 Information You Submit. When using the Services, you may upload, transmit, post, or publish your or a third party’s Personal Data to the Services, including images, videos, pictures and other information. You may not upload, transmit, post, or publish any sensitive information to or on the Services. You agree to obtain prior explicit consent from the relevant third party of whose information you post, transmit or publish on or to the Services. We may process this information to provide you with the Services and to comply with our obligations.

1.2 Registration Information. When you sign up and/or use the Services, we may ask you for registration information including username, password, phone number and email address. We will process this information in order to provide you with access to and use of the Services under your credentials. This processing is necessary for conclusion and performance of a contract between you and us.
1.3 Your Contact Information. If you are a customer representative that signed a contract with the Company, we may ask you to provide Personal Data, including full name, professional affiliation, your affiliation contact information including address, work email address and phone number. We will process this information to administer the Services, carry out our obligations, verify and carry out financial transactions, contact you for technical and administrative needs related to the Services, replying to inquiries and troubleshooting. This processing is necessary for the purposes of the legitimate interests pursued by Company of providing efficient and effective Services to our customers.
1.4 User Communications. When you send emails or other communications to us, we may ask you to provide Personal Data including your full name and email address, in addition to any Personal Information you choose to provide use with as part of such communications. We will process this information for the purpose of responding to your inquiries and providing you with the information you have requested. This processing is necessary for the purposes of the legitimate interests pursued by Company of providing efficient and effective Services to our customers.
1.5 Aggregate and Analytical Data. When you access and/or use the Service, we will automatically collect aggregate and analytical Personal Data related to account activities (including type of scanning performed by use of the Services), online identifiers (including IP address, Cookie ID and unique identifiers), and location. We will process this information in order to produce insights regarding use of the Services, usage trends, users’ preferences, and in order to improve our services and develop and improve automated processes on our Services. This processing is necessary for the purposes of the legitimate interests pursued by Company of providing efficient and effective Services to our customers.
1.6 Third Parties. We sometimes supplement the Personal Data with information that is received from third parties.
1.7 Other purposes of processing your Personal Data. We may use your Personal Data for the following purposes:

(a) Security. We may process your Personal Data to protect the integrity of the Services; to prevent, detect, mitigate, investigate, and protect against misuse of Company’s systems, fraud, crime, security breaches, and potentially prohibited or illegal activities or otherwise to protect Company’s or third-party rights or interests. This processing is based on our legitimate interests to ensure security of the Services.
(b) Legal. We may process your Personal Data to comply with the law; to resolve disputes; to cooperate with government or other legal inquiries, and to respond to subpoenas, court orders, or legal process; fulfill regulatory reporting obligations; to establish or exercise our legal rights or defend against legal claims and otherwise protect Company’s or others’ rights/assets. This processing is based on Company’s legal obligations, and/or, where non-applicable, Company’s legitimate interests to comply with applicable regulations and defend Company’s interests in court.
(c) Business Transactions. We may process your Personal Data in connection with a merger, acquisition, consolidation, bankruptcy, or other corporate transition, affecting all or part of Company’s assets, including during due diligence.

2. Cookies and Web Beacons

In order to collect the data described herein we may use temporary cookies that remain on your browser or device for a limited period of time. We may also use persistent cookies that remain on your browser or device until the Services are no longer accessed, in order to manage and maintain Company’s Services and record your use thereof.
A cookie is a small piece of information which is sent to and stored on your browser or device. Cookies do not damage your browser or device. You may not be able to use some of the Services features if you block them.
We may use remarketing services to inform you of new opportunities by placing ads on third party websites to you. We and our third-party vendors, use cookies to inform, optimize and serve ads based on your past visits to our website or app.
To opt in or opt out of certain cookies, please modify your cookie settings. Most browsers allow you to block cookies, but you may not be able to use some features on the Services if you block them. You may set most browsers to notify you if you receive a cookie (this enables you to decide if you want to accept it or not).
3. Third Party Links
We may display links to other services, sites, and applications on our Services for your convenience. We are not responsible for the privacy practices or the content of other sites and applications, and you visit them at your own risk. This Privacy Policy applies only to Personal Data collected by us through your use of our Services.
4. Children

If you are a minor under the age of 18, you must obtain parental consent prior to using our Services. We will not knowingly contact or engage with children under the age of 18 without said parental consent. If you have reason to believe that a child has provided us with their Personal Data, please contact us at the address given above and we will endeavor to delete that Personal Data from our databases.

5. Personal Data Sharing

For us to be able to provide our services, our affiliates, agents, and representatives may need to have access to your Personal Data.

We may also need to contract with partners and third-party service providers to perform certain functions on our behalf. To this end, we limit these parties’ access to the Personal Data they need to perform the functions they carry out on our behalf. We require these parties to process your Personal Data in compliance with this Privacy Policy and subject to security and other appropriate confidentiality safeguards.

We may also share your Personal Data in the following circumstances: (a) as required for providing the Services; (b) for maintenance and improvement of the Services; (c) if we become involved in a reorganization, merger, consolidation, acquisition, or any form of sale of some or all of our assets, with any type of entity, whether public, private, foreign or local; and/or (d) to satisfy applicable law or prevention of fraud or harm or to enforce applicable agreements and/or their terms, including investigation of potential violations thereof.

6. Data Security

We follow generally accepted industry standards to protect against the unauthorised access to or unauthorised alteration, disclosure or destruction of your personal data. However, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, while we strive to protect your personal data, we cannot guarantee its absolute security.

7. Data retention periods

We retain Personal Data we collect as long as it remains necessary for the purposes set forth above, all in accordance with applicable laws, or until you express your desire to exercise your rights as specified below.

Other circumstances in which we will retain your Personal Data for longer periods of time include: (i) where we are required to do so in accordance with legal, regulatory, tax, or accounting requirements; (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges; or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Data. Please note that except as required by applicable law, we may at our sole discretion, delete or amend information from our systems, without notice to you, once we deem it is no longer necessary for such purposes.

8. Data Integrity.

We process Personal Data only for the purposes for which it was collected and in accordance with this Privacy Policy or any applicable service agreements. We review our data collection, storage and processing practices to ensure that we only collect, store and process the Personal Data needed to provide or improve our Services. We take reasonable steps to ensure that the Personal Data we process is accurate, complete, and current, but we depend on you to update or correct your Personal Data whenever necessary. Nothing in this Privacy Policy is interpreted as an obligation to store information, and we may, at our own discretion, delete or avoid from recording and storing any and all information.

9. Your Rights

The following rights are extended to you with respect of any Personal Data collected or processed by the Company, as required of the Company under applicable law. We have summarised below your rights in relation to the Personal Data we collect and process:

(a) Right of Access and Rectification. You have the right to know what Personal Data we collect about you and to ensure that this data is accurate and relevant for the purposes for which we collected it. We allow our users the option to access and obtain a copy of their Personal Data and to rectify such Personal Data if it is not accurate, complete, or updated. However, if we can’t confirm your identity when you request this copy, we may need to ask you for further information or documents to identify you.

(b) Right to Delete personal data or Restrict Processing. You have the right to request us to delete your Personal Data or restrict its processing. We may postpone or deny your request if your Personal Data is in current use for the purposes for which it was collected or for other legitimate purposes such as where we are legally required to retain or process this data.

(c) Right to Withdraw Consent. You have the right to withdraw your consent to the processing of your Personal Data that is based on your consent. This will not affect any data we process before you withdraw your consent.

(d) Right to Object. You have the right to object to our processing if we are processing your Personal Data based on legitimate interests, using your Personal Data for direct marketing (including profiling), or processing your Personal Data for purposes of scientific or historical research and statistics.

(e) Right of Data Portability. Where applicable, you have the right to ask to transfer your Personal Data to a third-party service provider in accordance with your right to data portability.

(f)  Right to Lodge Complaint. You also have the right to lodge a complaint with a data protection supervisory authority regarding the processing of your Personal Data.

10. Enforcement.

We regularly review our compliance with this Privacy Policy. Please feel free to direct any questions or concerns regarding this Privacy Policy or our treatment of Personal Data by contacting us as provided above. When we receive formal written complaints, it is our policy to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of Personal Data that cannot be resolved between the Company and an individual.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you about significant changes in the way we treat your Personal Data by placing a prominent notice on our website or app. We encourage you to periodically review this Privacy Policy for the latest information about our privacy practices.

Any changes will be effective immediately once the revised Privacy Policy is made available on our website or app unless otherwise specified. If you continue to use our Services after the changes become effective, we will assume you agree to these changes.

12. Cross-Border Transfer

The server on which our Services are hosted and/or through which our Services are processed may be outside the country from which you access our services.

Some of the data uses and disclosures mentioned in this Privacy Policy may involve the transfer of your Personal Data to various countries around the world that may have different levels of privacy protection than your country and may be transferred outside of the UK or the European Economic Area.

If there is a transfer of your Personal Data outside the EEA we will, in the absence of an EC Adequacy decision relevant to the destination country or to the transfer, seek to rely on appropriate safeguards such as entering into appropriate EC approved standard contractual clauses (see https://commission.europa.eu/law/law-topic/data-protection/international-dimension-data-protection/standard-contractual-clauses-scc_en). By submitting your Personal Data through the Services, you consent, acknowledge, and agree that we will collect, use, transfer, and disclose your Personal Data as described in this Privacy Policy.

13. Your California Privacy Rights and Do Not Track Notices.

California Civil Code Section 1798.83 permits customers of Company who are California residents to request certain information regarding its disclosure of Personal Data to third parties for their direct marketing purposes. To make such a request, please send an email to info@zimark.io. Please note that we are only required to respond to one request per customer each year. You are also advised that Company does not respond to “Do Not Track” signals.
